Terms of use and service

1. Who these terms cover. These terms cover use of awning.one and the services sold by Awning, a division of Poseidon Network Systems CC (registration number 2002/102980/23). By using the site or placing an order you agree to them.

2. The free call and scorecard. The 15-minute call is free, and so is the on-screen scorecard result. The emailed report is free in exchange for your contact details. Scores come from our own method, change as sites change, and are not a guarantee of search ranking, traffic or sales.

3. Packages and prices. Prices on the site are one-time prices for the stated package, shown in US dollars, with VAT added where it applies. A fixed quote follows the free call. The founding-client offer gives 20% off the one-time price for our first 5 clients, in exchange for our right to show their before and after and a short testimonial, which they approve first.

4. Payment. The once-off fee is payable only after you have seen and agreed the concept and mock-up. Until then you pay nothing. Once you agree them, we take 50% to start the full build and 50% at launch, unless the quote says otherwise.

4A. Concept and mock-up. Before we start a concept, the free call confirms the work is a good fit, and we may decline a project. We then prepare a concept and a mock-up at no charge, with up to 2 rounds of changes. Further changes at this stage count as part of your paid revision rounds. The concept and mock-up, and the rights in them, stay ours until the first payment is made. Until then we share them for viewing only, as a watermarked image or a viewing link, and you may not copy them, use them or give them to anyone else. Your agreement must be in writing, and an email reply that clearly accepts the concept and mock-up counts. If we do not hear from you within 14 days of sending them, the offer lapses and we may stop work. If you decline or the offer lapses, you owe nothing and we keep all rights in the concept and mock-up.

5. Delivery. Delivery times (7, 14 and 28 days) are counted from when you have agreed the concept and mock-up and we have your logo, text and photos. Delays in supplying materials or feedback move the date.

6. Revisions. Each package includes 2 revision rounds. Extra rounds, extra pages, copywriting and photography are quoted separately.

7. Ownership. Once paid in full, you own the website, your domain and your content. We keep our own tools, templates and know-how. You give us permission to use materials you supply for the project.

8. Care plan. The care plan is optional, billed monthly and can be cancelled at any time. It covers hosting, security updates, backups, uptime checks, a set number of edits each month, stated in your quote and a monthly report.

9. Your responsibilities. You confirm that the text, images and logos you give us are yours to use, and that you will reply to us within 2 working days so the live date holds.

10. Results. Examples on this site are illustrative. Results vary with your market, offer and effort, and we do not promise specific rankings, leads or sales.

11. Liability. To the extent the law allows, our liability is limited to the amount you paid for the service in question, and we are not liable for indirect or consequential loss. Nothing here limits rights you have under South African consumer law.

12. Governing law. These terms are governed by the laws of South Africa.
